Limited Warranty

THE CAPTAINS WAREHOUSE LLC D/B/A EVER WATCH SYSTEMS warrants its products to be free from defects in material and workmanship under normal use for a period of twenty four (24) months from the date of retail purchase unless otherwise stated in writing by EVER WATCH SYSTEMS.

If the warranted products are returned to EVER WATCH SYSTEMS during the period of coverage, EVER WATCH SYSTEMS will, at its option, repair or replace without charge those items it finds defective.

Any replacement and/or repaired parts are warranted for the remainder of the original warranty or ninety (90) days, whichever is longer.

Such repair or replacement is the sole and exclusive remedy regarding all EVER WATCH SYSTEMS products.

The original purchaser must promptly notify EVER WATCH SYSTEMS in writing, during the warranty period, that there is a defect in material or workmanship.

There is absolutely no warranty on software, and all software products are sold as a user license under the terms of the separate software license agreement included with the product.

EVER WATCH SYSTEMS will not warranty any product which has been modified, opened or used in an unapproved manner. It is the original purchasers responsibility for: shipping costs, VAT, customs fees to and from EVER WATCH SYSTEMS.

EVER WATCH SYSTEMS IS NOT RESPONSIBLE FOR PRODUCTS THAT ARE LOST OR DAMAGED DURING SHIPMENT AND ALL SHIPPING AND INSURANCE COSTS ARE THE SOLE RESPONSIBILITY OF THE ORIGINAL PURCHASER. EVER WATCH SYSTEMS ADVISES THAT ALL PRODUCTS BE ADEQUATELY INSURED PRIOR TO SHIPMENT TO EVER WATCH SYSTEMS FOR WARRANTED SERVICE.

EXCEPT AS SPECIFICALLY STATED HEREIN, ALL EXPRESS OR IMPLIED WARRANTIES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ALL STATUTORY WARRANTIES, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR OTHER WARRANTIES, ARE EXPRESSLY DISCLAIMED. WITHOUT LIMITATION OF THE FOREGOING, DUE TO LIMITATIONS OF MONITORING SYSTEMS AND EXTERNAL SENSORS. EVER WATCH SYSTEMS DOES NOT WARRANT THE INSTALLATION OF PRODUCTS AS EVER WATCH SYSTEMS DOES NOT PROVIDE INSTALLATION SERVICES.

IN NO EVENT WILL EVER WATCH SYSTEMS BE LIABLE TO ANY BUYER OR USER FOR ANY LOSS OR DAMAGE, WHETHER DIRECT OR INDIRECT OR CONSEQUENTIAL OR INCIDENTAL, INCLUDING WITHOUT LIMITATION, ANY DAMAGES FOR LOST PROFITS, STOLEN GOODS, VESSEL LOSS, VESSEL DAMAGE, VESSEL SUB-SYSTEMS LOSS OR DAMAGES OR FROM CLAIMS MADE BY ANY OTHER PARTY CAUSED BY DEFECTIVE PRODUCTS OR OTHERWISE RELATING TO THE PRODUCTS SOLD. NOTWITHSTANDING THE ABOVE, EVER WATCH SYSTEMS’S MAXIMUM LIABILITY, IF ANY, WILL BE STRICTLY LIMITED TO THE PURCHASE PRICE OF ANY DEFECTIVE PRODUCT.

Upon receiving an authorization for warranty service, please return the product(s) as requested to EVER WATCH SYSTEMS. EVER WATCH SYSTEMS will not accept any shipment without prior authorization.

BEWARE: Dealers, distributors, installers and/or others selling EVER WATCH SYSTEMS products are not authorized to modify this limited warranty or make any additional warranties that are binding on THE CAPTAINS WAREHOUSE LLC D/B/A EVER WATCH SYSTEMS, or its affiliates, subsidiaries or related persons, unless otherwise stated in writing.

Limitations of the Ever Watch Systems Monitoring Service

Please note that while the EVER WATCH SYSTEMS monitoring service is a highly advanced solution, it does not guarantee protection against fire, sinking, dead batteries, fuel levels, engine status and/or codes, burglary, or any other emergency. Such limitations are due to several possible reasons, including but not limited to, inadequate or improper installation, positioning, sensor limitations, battery performance, wireless signal interruption, inadequate maintenance, the potential for the system to be compromised or circumvented, or lack of mobile data coverage.

Any monitoring service should therefore be considered as one of many tools to reduce risk and/or damage for the aforementioned, but not limited to, emergencies.

EVER WATCH SYSTEMS strongly recommends regular maintenance of all sensors, controllers and sub-systems related to the EVER WATCH SYSTEMS product.

General Terms

This limited warranty shall be governed and interpreted in accordance with the laws of the Palm Beach County in the State of Florida, USA.

User agrees that this limited warranty is the complete and exclusive statement of EVER WATCH SYSTEMS product warranty.

The EVER WATCH SYSTEMS limited warranty does not include any software or related products, and that this limited warranty supersedes all prior and contemporaneous agreements, proposals, negotiations or discussions, oral or written, relating to the subject matter herein.

Representations or statements of any kind, including, but not limited to, dealer advertising or presentations, oral or written, made by any agent or representative of EVER WATCH SYSTEMS which are not stated herein shall not be binding on EVER WATCH SYSTEMS.

EVER WATCH SYSTEMS shall not be liable for failure to provide warranty service if such failure results, directly or indirectly, from, but not limited to, fire, explosion, strike, freight embargo, act of God, or the public enemy, war, civil disturbance, act of any government, de jure or de facto, or any agency or official thereof, labor shortage, transportation contingencies, unusually severe weather, default of manufacturer or supplier, quarantine or restriction, epidemic or catastrophe or other similar event beyond the control of EVER WATCH SYSTEMS.
